Terms & Conditions

Last updated: 25 October 2026

This website is operated by Kweststudio Limited, a company registered in England & Wales (company number 17447648), registered office 16 Harbour Road, Par, St Austell, Cornwall, PL24 2BB. In these terms, "we", "us" and "our" refer to Kweststudio Limited.

1. About us

Kweststudio Limited is a company registered in England & Wales under company number 17447648. Our registered office is 16 Harbour Road, Par, St Austell, Cornwall, PL24 2BB. You can reach us at [email protected] or on +44 7723 139 704, Monday to Friday, 09:00–17:30.

These terms apply to your use of this website (trustsoft.uk) and to the services we supply, unless a signed agreement between us says otherwise. Where the two differ, the signed agreement prevails.

2. The services

We design and build software for businesses and other organisations in the UK:

What is not included. We do not supply hardware, connectivity or third-party software licences. Third-party charges such as hosting, domain names, app-store fees, payment-processor fees and paid APIs are payable by you and are shown separately in your quote. We do not build products for gambling, cryptocurrency or advertising-technology businesses.

3. Bookings, enquiries and orders

This website does not take orders or payments. You book an introductory call or a scoping consultation, or send an enquiry, through the form on this website, by email or by phone. A booking is a request for a meeting, not an order. The 30-minute introductory call and the 90-minute scoping consultation carry no charge and no obligation.

After a call we send a written quote for a discovery sprint or, for smaller work, for the work itself. A contract is formed only when you accept a quote in writing (an email is enough) and we confirm the start date. Nothing on this website is an offer capable of acceptance.

4. Prices and quotes

Prices on this website are starting figures in pounds sterling, shown as "from" amounts and excluding VAT. At the end of a discovery sprint we give you a fixed price and a delivery date for the build described in the signed specification. That price does not change unless you change the scope. Any change is quoted in writing and approved by you before we start it. Quotes are valid for 30 days from the date of issue.

5. Payment

Invoices are payable within 14 days by bank transfer to the account shown on the invoice. If a business client pays late we may charge statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 and pause work until the account is settled.

6. Delivery and your responsibilities

We work remotely and at our studio in Par, and on your premises where the quote says so. The delivery date for a build is set out in the quote. If we expect to miss it we will tell you as soon as we know, give the reason and agree a new date with you.

To deliver on time we need a named contact who can make decisions, answers to questions within 3 working days, access to the systems and data the specification relies on, and accounts with the third-party services the build uses. Delays caused by missing access, information or decisions move the delivery date by the same amount.

7. Cancellation

Business clients. A support and hosting retainer can be ended by either side on 30 days' written notice. A discovery sprint, audit or build can be cancelled in writing at any time; you pay for the work done and the third-party costs committed up to the date of cancellation, and you receive everything produced to that point.

Consumers. If you are an individual buying outside your trade or profession, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days from the day the contract is formed to cancel for any reason, by telling us in writing. If you ask us to start within those 14 days and then cancel, you pay for the work supplied up to the point of cancellation.

8. Refunds

If a deliverable does not match the signed specification, or a service is not carried out with reasonable care and skill, tell us within 30 days of handover and we will fix it at no charge. If we cannot do so within a reasonable time, we will refund the part of the price that relates to the fault.

Retainer fees paid in advance are refunded pro rata for any period after the retainer ends. Approved refunds are paid within 14 days to the account the payment came from. Consumers also have the rights set out in the Consumer Rights Act 2015, which these terms do not reduce.

9. Intellectual property

Software, specifications and other deliverables we create for you remain our property until the invoices for them are paid in full. On full payment, ownership of everything written specifically for you passes to you, together with the source code, hosting credentials and documentation.

We keep ownership of our pre-existing tools, libraries and know-how, and grant you a perpetual, non-exclusive, royalty-free licence to use them as part of the deliverables. Open-source components stay under their own licences. Material you supply to us remains yours, and you confirm you have the right to let us use it for the work.

10. Confidentiality and data

We keep confidential everything we learn about your business and systems, and use it only to provide the services. Where we process personal data on your behalf we do so on your documented instructions under a data processing agreement. Our Privacy Policy explains how we handle personal data as a controller.

11. Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, our total liability to you in connection with a contract is limited to the fees you paid us under that contract in the 12 months before the claim arose. We are not liable for loss of profit, loss of business, loss of goodwill or any indirect or consequential loss, or for faults caused by third-party services outside our control.

12. Use of this website

The content of this website is general information and not advice for your particular circumstances. We take care to keep it accurate but do not promise that it is complete or that the site will always be available. You must not misuse the site, attempt to gain unauthorised access to it, or copy its content for commercial use without our written permission.

13. Complaints and disputes

If something goes wrong, contact us first at [email protected] or on +44 7723 139 704. We acknowledge complaints within 2 working days and aim to resolve them within 14 days. If we cannot agree, both sides will consider mediation through a mediator accredited by the Civil Mediation Council before starting court proceedings. If mediation fails or is declined, the dispute goes to the courts under section 14.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts.

15. Changes to these terms

We may update these terms from time to time. The version in force when you accept a quote applies to that contract. The date at the top of this page shows when they were last changed.
